18 U.S.C. §2257 Exemption Statement
Why US performer record-keeping rules do not apply to AI-generated Outputs — and who is the producer when real-person reference material is used.

Vellux (vellux.ai) is operated by Dennis Müller, c/o Anibarro, Unit #152, Route de Saint-Cergue 24Bis, 1260 Nyon, Switzerland ("Vellux", "we", "us", "the operator"). This statement explains how the United States federal record-keeping requirements of 18 U.S.C. §2257 and §2257A, and their implementing regulations at 28 C.F.R. Part 75, relate to the Service. Capitalised terms have the meaning given in the Terms of Service.
1. Exemption for AI-generated Outputs
Vellux is an AI image- and video-generation platform. The Outputs generated on Vellux are synthetic images and video produced by artificial intelligence. Except to the extent a user supplies photographs of a real person, Outputs are not photographs or recordings of actual human beings engaged in actual or simulated conduct: there is no performer, and therefore no performer age-verification record that could be created or kept.
Wholly AI-generated Outputs accordingly fall outside the definition of matter to which the record-keeping requirements of 18 U.S.C. §2257 and §2257A and 28 C.F.R. Part 75 apply. This statement is posted for the avoidance of doubt; it does not limit any prohibition in the Content Policy.
2. Real-person reference material
Some features accept photographs of real people supplied by the user — reference images, and the character/LoRA training described in the Content Policy (Section 6). Where you upload photographs of a real, identifiable adult, you, not Vellux, are the producer of any depiction you then generate. You are solely responsible for holding that person's explicit consent, for confirming that they are an adult, and for creating and keeping any age-verification records the law of your jurisdiction requires — as you attest under the Terms of Service and the Content Policy, and we may require you to produce the underlying proof at any time.
Outputs are delivered to the generating user's private, per-account Gallery. Vellux does not operate a public showcase of, and does not itself produce for publication, sexually explicit depictions of real persons.
3. Age of depicted persons
Vellux permits only depictions of adults. Any sexual or sexualised depiction of a minor — real or synthetic, however produced — is prohibited absolutely, is treated as CSAM under the Content Policy (Section 3), and is reported to the competent authorities. Users must ensure that every person depicted in their Outputs is, and clearly appears to be, 18 years of age or older.
4. Removal requests
A real person depicted in Content or an Output without consent can have it removed on a priority fast track — no Vellux account is required. See Complaints, Reports & Takedowns (Section 5): we aim to action valid removal requests within 24 hours, and commit to the 48-hour maximum contemplated by the US Take It Down Act.
